【摘要】:Uses8212;Thispracticeisintendedforuseonavoluntarybasisbypartieswhowishtoassesstheenvironmentalconditionofforestlandorruralpropertyof120acresorgreatertakingintoaccountcommonlyknownandreasonablyascertainableinformation.WhileuseofthispracticeisintendedtoconstituteallappropriateinquiryforpurposesoftheLLPs,itisnotintendedthatitsusebelimitedtothatpurpose.Thispracticeisintendedprimarilyasanapproachtoconductinganinquirydesignedtoidentifyrecognizedenvironmentalconditionsinconnectionwithaproperty.Noimplicationisintendedthatapersonmustusethispracticeinordertobedeemedtohaveconductedinquiryinacommerciallyprudentorreasonablemannerinanyparticulartransaction.Nevertheless,thispracticeisintendedtoreflectacommerciallyprudentandreasonableinquiry.(Seesection1.7.)ClarificationsonUse:UseNotLimitedtoCERCLA8212;Thispracticeisdesignedtoassisttheuserindevelopinginformationabouttheenvironmentalconditionofapropertyandassuch,hasutilityforawiderangeofpersons,includingthosewhomayhavenoactualorpotentialCERCLAliabilityand/ormaynotbeseekingtheLLPs.ResidentialOccupants/Lessees/PurchasersandOthers8212;Noimplicationisintendedthatitiscurrentlycustomarypracticeforresidentialoccupants/lesseesofmultifamilyresidentialbuildings,occupants/lesseesofsingle-familyhomesorotherresidentialrealestate,orpurchasersofdwellingsforone''sownresidentialuse,toconductanenvironmentalsiteassessmentinconnectionwiththesetransactions.Thus,thesetransactionsarenotincludedinthetermforestlandorruralpropertytransactions,anditisnotintendedtoimplythatsuchpersonsareobligatedtoconductanenvironmentalsiteassessmentinconnectionwiththesetransactionsforpurposesofallappropriateinquiryorforanyotherpurpose.Inaddition,noimplicationisintendedthatitiscurrentlycustomarypracticeforenvironmentalsiteassessmentstobeconductedinotherunenumeratedinstances(including,butnotlimitedto,manyforestlandandruralacreageleasingtransactions,manyacquisitionsofeasements,andmanyloantransactionsinwhichthelenderhasmultipleremedies).However,forestlandandruralacreagetransactionsmayincludeimprovements(including,butnotlimitedto,residentialdwellings,barns,sheds,garages,andgreenhouses).AreaswithsuchimprovementsshallbeexaminedduringthesitereconnaissanceasdescribedinSection9.Inspectionofsuchimprovementswillnormallyfocusontheexteriorofthestructures.Theenvironmentalprofessionalshalldetermine,inhis/herprofessionaljudgment,whethertheinteriorinspectionsofsuchimprovementsarewarranted.Factorsinfluencingthisdeterminationcanincludewhether:(1)thereisspecificknowledgeofapotentialenvironmentalconcern,(2)theimprovementisaccessible,and(3)theinspectioniscoordinatedbythekeysitemanager.Site-specific8212;
